Terms & Conditions

A. Your decision to use the MacFarlane’s website (www.macfarlanesdeli.co.uk) and services offered herein indicates your agreement to be bound by the following terms and conditions.  As such, you are agreeing to familiarise yourself with the conditions, and to abide by them if you choose to use The MacFarlane’s website.

B. Our Terms and Conditions  are here to explain the rights and obligations you have. You may have other rights granted by law and these Conditions of Use do not affect these. This does not affect your legal rights as a consumer.

C. Cheese along with all the fresh food from MacFarlane’s is freshly cut to order and is a perishable product with a limited shelf life of around 7 days. Please bear this in mind when placing your order and choosing your delivery date.

D. Cheese is handmade and therefore a variable product, the weights listed are all approximate. We hand-cut our items (unless they are individual, individually wrapped or vac packed) and therefore certain weight variations can occur. We endeavour to be as accurate as possible.

Delivery

A full list of delivery charges is available at the time you place your order.

The price you choose will be established depending on distance of delivery, time of day, time of year along with availability of carrier amongst other factors of our Third Party Delivery partner.  MacFarlane’s does not set delivery pricing, availability of delivery or time taken to reach the end user. 

3 Please be aware that these charges can change at any time and that all delivery charges are non-refundable.

We reserve the right to re-charge for delivery should the wrong delivery details be given or no one accepts the delivery at the requested delivery address causing a delay in the courier delivery service. 

Whilst we endeavour to deliver your order during the selected  time slot please allow for traffic delays and any unforeseen circumstances encountered by your delivery driver. 

We cannot be held responsible for non-delivery due to adverse weather conditions or situations beyond the control of our Third Party delivery partners.You are expected to add any additional information that will enable the delivery driver to make your delivery.

You are expected to be available to receive your delivery. If you are sending a delivery as a gift you are expected to ensure that the recipient is available to receive the delivery. 

Every reasonable effort will be taken to make the delivery. A failed delivery will not automatically provide you with a opportunity to make additional requests including refunds and replacement of goods or services to MacFarlane’s. 

Ensure you have provided an accessible telephone number to ensure that MacFarlane’s and the driver driver can make contact with you while a delivery is out on the road. 

MacFarlane’s is using a Third Party company to make deliveries and in the case of any issues time must be provided to allow all parties involved to review any issues that may occurs. 

Any delay in dispatch and/or delivery for whatsoever reason shall not be grounds for a claim for consequential loss. 

Online Card Transactions 

MacFarlane’s is using a Third Party for card payments. 

MacFarlane’s does not under any circumstances electronically store any card details or any other personal information. 

Payments may take time to be viewed on your statement. Please allow 7 days plus from purchase or refund to see the transaction on your statement. 

The Abbeville Road shop can not, under any circumstances take payments or make refunds for online orders. If you visit the shop we reserve the right to review any issue before making any decision with regards to payment or refund. 

Online orders and payments can not be used as a basis for a transaction in the Abbeville Road shop. Please do not bring an online transaction to the shop for fulfilment of said order.  

Refunds

This policy sets out the returns policy for goods or services purchased through the online store operated by MacFarlane's.

To be eligible for a refund, your item must be unused and in the same condition that you received it, and it must be in the original packaging.

Some types of goods are exempt from being returned for a refund where they are perishable (e.g. fresh food not in a tamper proof container) 

Food items delivered could be returned and refunded if they are faulty, un fit, out of date or damaged.  Items can not be refunded because they unwanted, do not suit personal taste or personal preference.  

Under the Consumer Contracts Regulations, if you change your mind about a purchase you have made within 14 working days after the date of delivery, you are entitled to a full refund of the original purchase price for the goods or services you wish to return, and the original postage and packaging charges made. You will not be entitled to a refund of the cost you incur in returning the item to us.

Our standard returns policy entitles you to a full refund of the purchase price and postage and packaging charges if you change your mind (i.e. the goods or services provided are not faulty or were not described properly) within 14 working days.

If the item you purchased was faulty or did not work properly, or you think the item was not as described in the item description, please contact us first before requesting a refund as we may be able to resolve your problem to your satisfaction.

Where you would like to return a physical product you have purchased, please contact us to let us know that you will be returning the item. To obtain a refund for a non-physical product (like a service) please contact us for further information about how this can be done.

Once your return is received and inspected we'll contact you to let you know whether your refund will be processed or not, and credit your original method of payment, within a certain amount of days.

If you haven't received a refund yet where we have told you we have issued one, please check your bank account or card statement to make sure it hasn't been received and then contact your bank as some banks or card companies take a number of days to credit your account.

If an item you purchased was purchased with a discount voucher, then we will only refund the amount that you paid (and not the amount the item was listed for).

If an item you purchased was in a sale then it may not be eligible for a refund if you have changed your mind. If you are in any doubt please contact us before making the purchase.
